  • AlsoME March 28, 2024 at 4:39 pm on FL: Convicted sex offender who hacked jumbotron at the Jacksonville Jaguars’ stadium gets 220 years"We haven’t even had a legitimate shooter yet." - Give it time... However, since guns can be difficult for a registrant to get, I think [other bad acts] might enter the stage first? Hopelessness produces dramatic results...but they take time. Also, I think behavior more akin to the man in this article will remain far, far more common. American Society mass manufactures hopelessness. Millions of people, little more than the walking dead. Stumbling through pointless lives of pain, isolation and... in some cases... anger. Bitter, burning, all consuming, resentful anger. Person like that, with absolutely no hope for the future, and nobody to change their perspective... is capable of anything.... anything....no limits... This is where mass shooters come from... especially the ones that plan on making this their last day on Earth, one way or another. Not all of them... some do it for revenge... for "God"...for love...for hate... for all kinds of reasons that can be understood.... this is one of the reasons for the "inexplicable ones", I suspect. This is also where substance abuse comes from! Again, not for all... but for some. Remember, drinking isn't the problem... it's the solution to all problems! Yep, people who drink don't have a drinking problem, they have a life problem and a drinking solution! Understanding that is critical to sobriety... understanding that the solution only makes the problems worse, while creating all new ones! Let's ask Google.... little better that 250 a day. Yep, 106,000 people in 2021, anyone of whom may have been hopeless enough to be a mass shooter, if they didn't have an alternative solution to their problems...that killed them. Let's be grateful that violence is not as common a solution as other stuff? America doesn't have a "Drug Problem" nor a "violence problem".... We just have a ton of hopeless people that have Drug and Violence solutions? I think maybe...

  • Janice Bellucci March 28, 2024 at 12:57 pm on CA Dept. of Justice Agrees to Reduce Some Tier AssignmentsSeveral people have asked how they will know that their tier has been reassigned. Because this court's decision is very new, no formal process has yet been identified. Having said that, I would go to the office where I register and ask for a Form 8050, Proof of Current Registration, because that form includes a person's tier assignment. If you obtain your Form 8050 and it does not say you are assigned to Tier 1, please contact me at jmbellucci@aol.com. Thank you.

  • AlsoME March 28, 2024 at 12:11 pm on CA Dept. of Justice Agrees to Reduce Some Tier AssignmentsI've been meditating on the concept of hopelessness quite a bit lately, but now I think I will reverse course. Once again ACSOL has given me reason to find hope. To find it, and hold on to it, and believe it is real. Hope is the most valuable commodity a human being can have, even more so than time. Without hope, time has no value. There is a word for this... time without hope...it is Hell... for that is what Hell is. An eternity of time...all made less than valueless...made torture. ACSOL: Once again you bring hope to the hopeless... and there is no greater gift, no finer act, no nobler deed, no...clearer expression of that which can only be called Devine. Practitioners of Faith believe that God works through people...perhaps, they are right? Time without hope is Hell, and you are forging a path out... As always, may all you hold to be good and true bless you and keep you, well. FORGE ON!
  • SR March 28, 2024 at 12:11 pm on CA Dept. of Justice Agrees to Reduce Some Tier AssignmentsJust read through the final judgement and it seems like the entire argument and the conclusion fell on whether or not the defendant was able to get 1203.4, with emphases being that "attempts are not as bad as other stuff in order to deny 1203.4 via 1203.4 (b)". So, if that's really the case, than shouldn't really anyone that qualified for 1203.4 be Tier 1 since none of those people were disqualified under 1203.4 (b)? I know they used this to finagle "attempts" in contrast to "completed" offenses, but the overall deal with that subsection is crimes that are considered serious enough to exclude them from 1203.4 in general. This ruling really does read to me like offenses that are "minor" enough to warrant a 1203.4 dismissal aren't bad enough to now be considered Tier 3 or 2 . Nor does the exclusion of attempts from the section 1203.4, subdivision (b) exception result in absurd consequences. To the 9 contrary, attempted crimes regularly are punished less severely than completed crimes.(§ 664 [establishing sentences for attempts at one-half the • length of those for the completed crime].) The Legislature reasonably could have concluded that perpetrators of attempted sex offenses should have the opportunity to expunge their records, while those who completed certain sex offenses should not. Accordingly, we conclude that the Legislature intended to exclude attempts from the section 1203.4, subdivision (b) exception.   If something isn't serious enough to prohibit granting of 1203.4, then how can it be concluded that Tier 3 is still appropriate? If legislatures thought something was serious enough to exclude a person from 1203.4, they would've amended 1203.4(b) to include any offenses they serious enough to register as Tier 2 and Tier 3.

I'm surprised the registry doesn't produce more retaliation. We haven't even had a legitimate shooter yet. (besides the FBI one) In a lot of ways it tends to show the character of lots of registrants. Empathy, morality, family values. The registry ruins many lives. It exists because it is not punishment. • Mike G March 28, 2024 at 9:16 am on International Travel 2024Yes, but apparently you have to prove that you are travelling within 14 days, and we would have to go to San Francisco (three-hour trip) and pay 'who knows what' extra, I'm sure. Last year they allowed half a million people to renew online and keep their old passport until the new one came, but I guess that made too much sense, so they stopped it. I plan to renew by mail today, requesting expedited service. They claim that will take 2 to 3 weeks, but I don't put a lot of trust in government claims.
  • Will Allen March 28, 2024 at 9:08 am on FL: Convicted sex offender who hacked jumbotron at the Jacksonville Jaguars’ stadium gets 220 yearsI don't think you understand. Registries radicalize people to want to retaliate. I'm fully committed to it. Personally, I'm not accepting ANY consequences from the Registries. Everything results in retaliation. Just to "set the stage", I'm extremely successful and very well off. But if I get cancer one day and then some criminal regime later arrests me for ANYTHING related to the Registries, people won't be able to say they weren't warned. I'll make this guy look like the Pope.

  • TS March 28, 2024 at 7:44 am on MO: Louisiana Bill SB371 to allow judges to sentence child sex offender with surgical castration advancesGently remind her, whether it is an election year ploy or not, there is no place for it as this is not medieval Europe, the old South, or even less than 100 years ago across the pond in Europe (as noted above) and she should be ashamed for even thinking of such punishment regardless of who she is thinking of protecting.
  • EdC March 28, 2024 at 6:47 am on FL: Convicted sex offender who hacked jumbotron at the Jacksonville Jaguars’ stadium gets 220 yearsAlthough I wish him the best, it is gonna be tough to get a sentence reduced. The feds are sticklers for procedural details and will challenge a petition if there is even a small mistake. For instance, if his lawyer didn't file a timely (14 days) notice of appeal, he is probably toast. The appeals court may find some chink in the government's armor and might even cut his sentence by half or more. At 53 years old, any sentence longer than 40 years is essentially life. He will likely be denied a writ of certiorari by the Supreme Court, which only accepts perhaps 2% to 3% of petitions each year. After cert denial, he has one year to file a habeas corpus motion (28 U.S.C. §2255). The federal district courts hate these because most are written pro se and often based on questionable constitutional claims, yet they still consume judicial resources. About the only way through the habeas door is with a claim of actual innocence, ineffective assistance of counsel or some no-kidding constitutional issue. I hate to be a downer, but realism is essential. Very little is more demoralizing in prison than to get ones hopes up only to have them dashed. I'd suggest exhausting all avenues of appeal because if one doesn't ask, the answer is always no. But don't have inflated expectations.

I don’t know the “cut off” for the term prolific, but seems he qualifies. As for his sentencing, committing these offenses after already being convicted before, plus owning a firearm as a felon and the lesser offenses he committed, this guy has zero respect for any type of law. • AlsoME March 27, 2024 at 10:23 pm on CA: Woodland serial sex offender receives multiple life sentencesFirst, and most importantly, please spare a thought for those girls. Nothing so horrible has happened to this man, that they should be forgotten. Now...a few thoughts.... If this guy is such an out of control predator, where are all his stranger victims? He continued to abuse these same girls for years... but where are the others? Seems he only abused victims he was able to get access to by winning the trust of the family. That's not predation, that just opportunistic.... there's a difference. Where are all the other families he used to gain access? Where is the pattern of gaining access to facilitate abuse? Where is the pattern of predation? Predators hunt for prey... this man seems more of a grazer than a hunter. Stay in one spot, and graze on what's there. I wonder if there were other kids he had access to, but were not abused? Almost as if he had found a good grazing spot, and there was no need to risk any others? This is not predatory behavior.... Last but not least, a sentence like this says only one thing to an actual predator... make sure nobody squeals...ever. Make absolutely sure none of them tell anyone, anything...ever. What are you going to do, make them die in prison twice? Make the consequences of their actions unsurvivable, then they have no reason not to try to avoid them at any and all costs. "Die in Prison" is what got Megan and Jessica killed. Might have been what got Jacob killed as well. How many more need to die for that?

But with our recent successful country enterings (is that a word?), I think we will just go for it. Conviction was 29 years ago, relatively light sentence, and off the registry almost 2 years now. What I am going to do, though, is get a Live Scan, so if my conviction is discovered, I will have proof of when it was and the sentence, and not expect them to take my word for it like they did in Japan.
  • EdC March 27, 2024 at 9:47 pm on FL: Convicted sex offender who hacked jumbotron at the Jacksonville Jaguars’ stadium gets 220 years"Only five victims"? I have to disagree, five hands-on molestations sounds pretty "prolific" to me. If the crimes had been murder, he would be described as a serial killer. At minimum, this guy is a very slow learner and the feds don't like repeat offenders. I agree that 220 years is an idiotic number, and it sounds like the judge is just grandstanding. Perhaps he is burnishing his resume for a slot on the circuit court.
  • Bob March 27, 2024 at 9:03 pm on CA: Woodland serial sex offender receives multiple life sentencesThis kind of sentence happened because the DA in Yolo County Jeff Reisig is a strict law-and-order jerk and likes to push for such long, outrageous sentences in plea deals, gambling that the judge will not give out a lesser one if the defendant goes to trial. He wants to get re-elected as he has done every two years for quite a long while now and probably will continue to be re-elected until he keels over dead at his desk or decides to run for higher office. He is responsible for the performative nonsense called Operation Vigilance where law enforcement perform compliance checks throughout Yolo County. Every year the Woodland PD show up at my door and pound on it demanding my attention. It is so obvious that they are police that I just ignore them as no registered citizen is required to respond to such inquiries. They go away empty handed and I'm free of them for another year, having only to deal with them around the time of my birthday.
  • Mig March 27, 2024 at 8:45 pm on MO: Louisiana Bill SB371 to allow judges to sentence child sex offender with surgical castration advancesI am a person forced to register in Louisiana. This is not the first time this bill has been presented. Last year it came up and a committee voted to delay it. Now, I suppose it is back. In addition to lynchings, Castration is one of the horrible things that were sometimes done by vigilantes to black males in the South back "in the day". Now, our legislature wants to make it legal. The irony is that this bill is sponsored/presented by a black woman. I wonder if she is aware that castration is one of the horrible and reprehensible tools that was used by racist groups in the last century. I wonder if those groups (i.e. KKK) would strongly support this bill. Sure, it falls under the "law of the land", but still... it sounds, smells, looks, feels, and tastes like a throw-back to an earlier and barbaric time when castration and lynching were applied together.
  • NorCal County March 27, 2024 at 8:36 pm on MO: Louisiana Bill SB371 to allow judges to sentence child sex offender with surgical castration advancesI doubt they can find a doctor that would do this surgery. Doctors aren't allowed to do harm, even with a judges request. But I'm also sure SCOTUS wouldn't allow it either and the politicians know that. But it sounds good just to get elected.
  • AlsoME March 27, 2024 at 8:27 pm on FL: Convicted sex offender who hacked jumbotron at the Jacksonville Jaguars’ stadium gets 220 yearsThis is another example of "Hopelessness in action?" He lost his job because he's a registrant, then he lost all hope for the future? Couldn't face a lifetime of false hope crushed by his past? So...go nuts? Get a gun, stack up some CP, hack into the Jumbotron, do the Hokey Pokey and turn yourself around... nothing matters anymore! Die in prison, die under a bridge, die in a motel bathroom with a rope around your neck... who cares? When there is no future other than the specific circumstances of when, where, and how you die...then, just do... whatever, until then! People that have no future have no reason to restrain themselves. People with no future, because they can't escape their past... get bitter. If all this guy has to look forward to was an endless series of jobs taken away because of his past, separated by unemployment and maybe some homelessness... then F it...take the Die in Prison option... and have fun with it! Do absolutely whatever... before you have to go. Similar to that Carjacking story... hopeless person just...loosing it? That guy wanted a car, and a "good reason" for ending his life in prison... this guy, little more random, but got some revenge for being fired?
  • Chris B March 27, 2024 at 8:22 pm on FL: Convicted sex offender who hacked jumbotron at the Jacksonville Jaguars’ stadium gets 220 yearsIndeed. I see, and I'm sure others do as well, a blatant display of the sheer inability of a list to prevent anything. Yet, again I say, we have incredibly infantile politicians who are as lazy as the day is long. Feel good laws are the worst part of what government produces for the governed.
  • Notorious D.I.K. March 27, 2024 at 8:10 pm on International Travel 2024Volaré, Because registration is entirely a state thing, which states get to determine, regardless of SORNA, federal foreign notifications are unlikely to be entirely, or perhaps even partially, dependent upon registration status. This would lead to Fourteenth Amendment challenges because the Federal government would be treating citizens differently depending on which state they were registered in. There are some signs that getting off the registry may have played a role in Mike's getting into countries that he was not previously able to, but because some people who have gotten off the registry have been turned away from some countries, it is unlikely to be absolutely determinative. Because we're all different people who bring different legal circumstances to the table, then I'm afraid that we're never going to have a black-and-white answer to our future successes.
  • Volaré March 27, 2024 at 6:29 pm on International Travel 2024Certainly true but Mike G also said he thought it might actually be considered a Level 3 under SORNA. ??

His case was federal, there was a federal judge, a federal prosecutor, & so on.What really sucks is that is he is only going to get a miscalculated 15% of good time each year. On a 60 month sentence they cheat you out of over a month of good time so he is really going to get cheated out of some time.

I would be very cautions until you can verify it.
  • Notorious D.I.K. March 27, 2024 at 6:02 pm on MO: Louisiana Bill SB371 to allow judges to sentence child sex offender with surgical castration advancesThe Nazis castrated gay men and put them in camps and some of them were put to death. But, hey, the Louisiana Nazis have to start somewhere! They've been itching to resurrect their castration bill since Gov. Bobby Jindal got slapped down years ago by SCOTUS before it got really packed. Everyone wants to give this scarier Court the very worst they can come up with: no abortion for rape victims, no birth control or morning-after pills, no books mentioning homosexuality in public schools, lots of prayer in public schools, no drag queens allowed in public libraries - it's all there! The South will rise again!

  • Notorious D.I.K. March 27, 2024 at 5:52 pm on MO: Louisiana Bill SB371 to allow judges to sentence child sex offender with surgical castration advancesSR, Oh, I'm speaking specifically of SCOTUS deference for state criminal justice positions. The conservative Justices can find almost nothing wrong with anything the states want to do to criminals or defendants. This is well-established, at this point. They've been fine with the condemned being put to death when their guilt is in doubt, for example. Now that they hold a supermajority on the Court, I think it is very much in question whether they will swat down states wanting to chemically, or surgically, for that matter, castrate [People convicted of a sexual offense] I'm thinking they might be okay with it and that it will follow the conservative vs. liberal split although Gorsuch or Roberts might dissent. Maybe Barrett because she's still a bit of a puzzle. Definitely Alito and Thomas will support castration and maybe Kavanaugh. But the liberals will not support it, of course.

  • AlsoME March 27, 2024 at 5:26 pm on CA: Victim was carjacked, kidnapped, assaulted in Central California by registered sex offender, police sayAnonymous, Policing is a Protection Racket. You get what you pay for. You want safety, pay for it. Don't pay, don't get. Of course there really is no way to create total protection, but pay enough you can get the illusion of it... That's where the Registry comes in! It helps create the Illusion of Protection, for people that can afford it. People that can afford to live in Suburbs, like the one I grew up in, all kinds of Illusions of Safety there! This is how the Teacher and the Little League coach got away with what they were doing for years and years. Things like that don't happen in "Nice places" like there... which is part of why living there is so expensive. Registry has way more to do with protecting property values than anything else. They get away with it, because registry produces very few new crimes. So they can shift the appearance of danger, Registrants, away from high property value places, to low value ones. Places that are so crime riddled already, doesn't matter! Extremely low recidivism rates keep this from becoming too obvious. If Registrants actually were Frightening and High recidivists, this would be obvious. If Registrants were really out of control Predators always on the hunt for new victims, my neighborhood would be a wasteland of victims! There are 8,000 registrants in my zip code... and we're all constantly hunting for our next victim?!?!??!?!?!? There would be hundreds a year! Do the math...1 victim a year on average would be 22 a day! Hell even 1 new victim every 20 years on average would still be 1 everyday! So where are all the victims? Where are the Registry thwarted attempts? Where is any evidence that any of this is rational to believe is true? Things aren't "Rational" just because you say they are... or because you "Know its true"... that's just delusional...or corrupt....or both! That's the Disposable Society we live in...nothing so demonstratively false, so categorically absurd, nor so inescapably corrupt it can't be declared an Unquestionable State Truth!

  • SR March 27, 2024 at 4:21 pm on General Comments Mar 2024What state are you in? California doesn't do anything automatically for Registrants. You have to file for removal from the current Tier registry, and you still have to file for the 1203.4 record setting aside as the recently passed law that does it automatically excludes those from this automatic benefit who have to register (you can still get it, but you have to petition for it as normal). What you received may be real, but it could also be a scam so that you miss your regular registration date and violate. Contact the DOJ and maybe visit your local court house to speak with a public defender to find out if the letter you have is legitimate.
  • SR March 27, 2024 at 4:13 pm on MO: Louisiana Bill SB371 to allow judges to sentence child sex offender with surgical castration advancesI don't think current SCOTUS is doing that poorly. • Notorious D.I.K. March 27, 2024 at 3:41 pm on Filming your front porch without a warrant is now fair game for the fedsNo, courts have ruled that you have a reasonable expectation of privacy (the key phrase) WITHIN your home, but it gets complicated by unobstructed windows. It then becomes more circumstantial. From one source: "Excellent explanation. What you say accords with what I've read on the subject, too. My only suggestion concerns the following: "Other than that, you may take pictures of people almost anywhere. For example, aperson may be photographed on their own property provided the photographer didnot enter the property to take the picture."In the U.S., this does not include use of long lenses to peer into windows from a distance. The relevant concept is "reasonable expectation of privacy." If someone's window is close to a public sidewalk and is open, curtains drawn back, so that any passerby can easily see inside, then the person does not have a "reasonable expectation of privacy", so if you snap a photo of someone within while walking by, you may well be within your rights. However, if the window is at a great height and distant from surrounding buildings, or if the curtains are closed, you may not use a long lense to peer in from a distance or between the curtains, because the person has either taken steps to ensure his privacy or has a "reasonable expectation of privacy" by virtue of his location." I would not want to be the photographer having to answer this in court. Now, if you're the police...?
  • Notorious D.I.K. March 27, 2024 at 3:29 pm on CA: Victim was carjacked, kidnapped, assaulted in Central California by registered sex offender, police sayGordon, I agree with you, broadly, but what you say about Europe isn't quite true. Some do have registries and some do put people in prison for cp. They're just not as extreme as we are in handing out absurdly long prison sentences. I do know someone in The Netherlands who was handed a prison sentence for advocating for the lowering of the age of consent back to what it was a number of years ago (twelve). He had previously been warned by the government who had forced his organization, Martijn, to disband previously for their advocacy of that position and, later, he wrote to others in an email group where it was discussed. One of the discussants turned him in and several of them, I think three, were arrested and sentenced. There is no First Amendment in Europe or, anywhere else, for that matter. Nothing of that power. In the U.S., you are free to advocate for a lowering of the AOC and there's nothing they can do about it. You will, however, have an investigation opened on you by local police and the F.B.I. if you go public or show up on a list. They may surveil you and you will be on their radar. As long as all you do is to advocate, however, there's nothing they can legally do to you, apart from such things as stopping you at Customs on your way back into the country and seizing all of your electronics, as happened to my friend a few months back, who had never been convicted of anything but had, as a journalist, both reported upon injustices committed against [People Forced to Register] and advocated for the liberalization of sex crimes, such as the lowering of the AOC. The Feds keep these files for a very long time, apparently, as he had not done any such journalistic advocacy in more than twenty years, as far as I know.
