FEE SCHEDULE

RETENTION OF SERVICES AS A MEDIATOR

The mediation fee is calculated based on an hourly billing rate of $600 per party, per hour, including any pre-mediation preparation time and post-mediation follow-up time spent on the matter. For four or more parties, the rate is $500 per party, per hour. For in-person mediations, an additional fee of $600 per party will be charged for travel. To avoid confusion, a “party” is defined as all parties who are represented by the same counsel.

PAYMENT POLICY

All fees are calculated using the per hour rate, and all invoices are due upon receipt. Following the conclusion of the mediation, each party will be billed for their portion of the fee, unless the parties agree otherwise. Payments should be made in accordance with the payment instructions on the invoice.

About Sam Rosmarin

Sam Rosmarin became a mediator after a long career as a litigator handling medical malpractice and personal injury cases

Sam began his legal career as a defense attorney representing a major New York hospital in malpractice and general liability matters and a national hotel chain in personal injury actions. After being offered a job that geographically allowed him to coach his two boys’ baseball teams, Sam became a plaintiff’s attorney specializing in medical malpractice, catastrophic injury and wrongful death actions. Sam has tried cases in every county of New York City, and several counties north of the City, but realized early on that he much preferred settling cases. That fervent preference ultimately led to an interest in mediating disputes.

 Once he became interested in mediating, Sam did what he always did as a litigator: prepared thoroughly. Sam attended the Harvard Negotiation Institute’s intensive week-long training program on Mediating Disputes in 2015 and has since attended Pepperdine Law School’s Strauss Institute program on Advanced Mediation and Cornell University’s Program on Employment Dispute Mediation. Sam is a full-time mediator and has been mediating cases since 2016. He was also appointed as a Special Master for the Appellate Division, First Department in New York. Sam currently focuses on private mediation.
