Mayor Keene opened the Public Hearing at 6 p.m.<br />

RESOLUTION NO. 20<strong>13</strong>-19; A RESOLUTION<br />

ADOPTING THE MILLAGE RATE TO BE LEVIED BY<br />

THE CITY OF ARCADIA, FLORIDA FOR FISCAL YEAR<br />

20<strong>13</strong>-2014 (Finance Director)<br />

Resolution No. 20<strong>13</strong>-19 was read in full. Mrs. Green explained that last years' millage rate was<br />

8.8859. This year the rolled back rate is 8.7867. The recommendation is for 8.6694 millage rate<br />

which is less than the rolled back or -1.33%. Deputy Mayor Heine questioned if this will meet the<br />

$22,000 short fall. Mrs. Jankosky stated that we also need to address the health insurance increase.<br />

The contingency in the General Fund is currently $650,000. Mrs. Jankosky replied to <strong>Council</strong>woman<br />

Frierson that this budget presented will assist in the situation we are currently addressing with<br />

Tallahassee.<br />

A motion was made by Deputy Mayor Heine and seconded by <strong>Council</strong>man Allen to adopt<br />

Resolution No. 20<strong>13</strong>-20 Tentative Millage as presented. The motion carried 5-0.<br />

RESOLUTION NO. 20<strong>13</strong>-20; A RESOLUTION<br />

ADOPTING THE TENTATIVE BUDGET FOR THE CITY<br />

OF ARCADIA, FLORIDA FOR FISCAL YEAR 20<strong>13</strong>-<br />

2014 (Finance Director)<br />

Resolution No. 20<strong>13</strong>-20 was read in full. Mrs. Greene reported that Code Enforcement was placed<br />

under the Police Department which was $66,<strong>15</strong>6 for a total Police budget of $1,507,733.<br />

<strong>Council</strong>man Allen stated he was acceptable with the current budget. <strong>Council</strong>man Fink commended<br />

the City Administrator for attempting to balance the budget. He stated that he would be unable to<br />

support this budget while the Police Department continues to expand. He still believes the State will<br />

come in as the $170,000 will not replenish the funds. He continued that there are Officers that take<br />

vehicles home, clerical staff and personnel that could have been reduced.<br />

A motion was made by Deputy Mayor Heine and seconded by <strong>Council</strong>man Allen to adopt<br />

Resolution No. 20<strong>13</strong>-20, Tentative Budget as presented.<br />

Mr. Gary Frierson, resident, explained that there still remains $400,000 in street improvements which<br />

could be reduced. He spoke also about the water and sewer account owing the general fund. If we<br />

had to we could utilize those funds as well. He feels the budget is a good budget and believes that<br />

things don't appear to be as dire as some may have made it out to be. Mayor Keene thanked all who<br />

worked on the budget. He recalled in past years the City did not even have a repair and replace fund<br />

and there was a $450,000 previous cost that had nothing to do with the current <strong>Council</strong>. He<br />

mentioned Broward County supporting legislation to help fund City Police Departments and<br />

suggested we might want to be on board.<br />

Vote on the original motion carried 4-1 with <strong>Council</strong>man Fink dissenting.<br />

Kevin Joens, 5 years of service - Presentation by Mayor<br />

Mayor Keene presented Mr. Kevin Joens a plaque representing his 5 years of City service with the<br />

<strong>Arcadia</strong> Police Department.<br />

4. Request for use of Speer Center - Toys for Tots, Marine Corps Reserve (Administrator)<br />

A motion was made by Deputy Mayor Heine and seconded by <strong>Council</strong>man Fink to allow the<br />

Toys for Tots to utilize the Speer Center for storage and distribution of toys. The motion<br />

carried 5-0.<br />

Mr. Robert Grinis thanked the <strong>Council</strong> for their generosity and asked about the general security of the<br />

building. Mr. Grinis also announced a Fundraiser Golf Tournament at the <strong>Arcadia</strong> Golf Course on<br />

October 19,20<strong>13</strong>. Marshal Anderson stated that the Speer Center has new doors and is considered<br />

a secure building.<br />

5. Lease of Former Police Station (Administrator)<br />

Mrs. Jankosky stated that she met with Red Cross and they would like to begin negotiations<br />

regarding leasing half of the former Police Station. <strong>Council</strong> gave consensus for the Administrator to<br />

move forward.<br />

6. Airport Lighting Grant (Administrator)<br />

Mrs. Jankosky asked if the <strong>Council</strong> may approve a low interest government loan to help move forward<br />

on the Airport Lighting grant project. <strong>Council</strong> gave consensus for Mrs. Jankosky to move forward with<br />

Government funding and return with a loan package for <strong>Council</strong>'s consideration.<br />

7. Prayer Policy (Attorney)<br />

Attorney Wohl stated this Resolution was brought forward for <strong>Council</strong> and Public review to comply<br />

with Church and State issues. <strong>Council</strong>man Fink thanked the City Attorney for being proactive. Mr.<br />

Charles Conklin questioned why no one on the <strong>Council</strong> could pray and he felt they should have a<br />

right to pray as well.<br />

8. Health Insurance (Administrator)<br />

Mrs. Jankosky stated that Health Insurance increases this year stem from 25% - 44%. Mr. Tom<br />

Guidry, DeSoto Insurance, stated that he tried to speak with United on the 65% increase however the<br />

City has seen many catastrophic claims this period. He stated that Blue Cross/Blue Shield was the<br />

most competitive at only a <strong>13</strong>% to <strong>15</strong>% increase. He explained several plans to include PPO, HMO<br />

and various deductibles. Mrs. Jankosky proposed the BC/BS HMO, $1,200 deductible with employee<br />

buy up to a $500 deductible plus an employee buy up to a PPO. She also suggested the deletion of<br />

the dependent plans as those plans cost the City considerable amounts. Mr. Guidry reminded also<br />

that Health Care Reform begins in January.<br />

<strong>Council</strong>man Fink asked the Administrator if she could provide a spreadsheet of alternatives as<br />

presented last year. Mr. Guidry replied to <strong>Council</strong>woman Frierson that many of our claims were due<br />

to outpatient procedures and catastrophic claims. Mr. Guidry replied to Mayor Keene that the City<br />

currently carries 16 dependents. Mr. Lew Ambler reminded <strong>Council</strong> that the City is very generous to<br />

provide dependent coverage.<br />

A motion was made by <strong>Council</strong>man Fink and seconded by Deputy Mayor Heine to move the<br />

City Health Insurance to BC/BS HMO Plan 61, removing depending coverage. Provide<br />

employees three options: 1) BC/BS Plan 61, $1,200 deductible, or buy up to: 2) Plan 60, $500<br />

deductible and 3) BC/BS PPO Plan which may cost an additional $60 per employee. The<br />

motion carried 5-0.<br />

9. Oak Ridge Cemetery (Public Works Director)<br />

Mrs. Miller explained the maintenance options for Oak Ridge Cemetery. She reviewed three options<br />

for securing the cemetery;<br />

A motion was made by Deputy Mayor Heine and seconded by <strong>Council</strong>man Fink to approve<br />

option 2: Install the gate adjacent to the bridge and remove the fence material that will no<br />

longer be needed. Total cost $332.50. The motion carried 5-0.<br />

<strong>10</strong>.Antique Association 4th Saturday Fair and 1 st Saturday Farmer's Market (Marshal Anderson)<br />

Marshal Anderson explained that there appears to be three different factions functioning in the<br />

downtown area and sponsoring different events. He stated that there is currently no code to enforce<br />

business owners not to place items outside the front of the store, the code only indicates "no blocking<br />

or obstructing sidewalks". He asked <strong>Council</strong> for clarification during these special events. Attorney<br />

Wohl stated that the code is vague on that particular issue; however he is drafting an Ordinance<br />

addressing special events. <strong>Council</strong>woman Frierson stated that the City could close down Oak Street<br />

from the railroad to the Church (Orange Ave.) Mr. Lew Ambler, DeSoto Insurance, stated that he did<br />

have concerns regarding the risks and liability during these events.<br />

Mr. James Lee, Business Owner, stated that the Antique Association appears to be picking and<br />

choosing who they want in their Association. He asked why the City doesn't take over this event.<br />

Mr. Frank Peterson, resident, stated that he usually sets up in front of an Attorney's Office however<br />

he was told he could no longer do that. He stated it appears that the Antique Association does not<br />

want outsiders at the event.<br />

Ms. Sheri Fink, VP of the Antique Association, stated the sellers are not paying the fees which are<br />

used for advertising at $30,000 per year. She added that the Antique Association gave Mr. Peterson<br />

three months extra due to his health issues. She stated that the Association does have vendor<br />

contracts with rules and regulations. The Association only wants to see items which are 1950 or<br />

older.<br />

Mrs. Marsha Brown, Methodist Church Secretary, stated that the Church sponsored events income<br />

goes directly to the needy and food drives.<br />

Deputy Mayor Heine suggested closing down Oak Street from DeSoto to Orange. <strong>Council</strong> gave<br />

consensus for the Attorney, Administrator and Code Enforcement to begin writing an Ordinance<br />

addressing special events.<br />

<strong>Council</strong>man Fink stated if the streets are closed and items are in the street then the visitors won't<br />

come into the stores. <strong>Council</strong>man Fink disclosed that he was a store owner and member of the<br />

Antique Association. His attorney noted no conflict regarding this subject.<br />

Mrs. Jackie Tucker explained that Mr. James Lee joined the Antique Association and paid for a year<br />

and also set up two spaces in front of his store. She advised that the City should take the event over.<br />

11. Revised Personnel Policy Manual (Human Resources)<br />

Mrs. Jankosky reviewed the changes to the revised personnel policy manual. All <strong>Council</strong> were in<br />

approval of the revisions however rejected the new President's Day Holiday.<br />

A motion was made by <strong>Council</strong>man Fink and seconded by Deputy Mayor Heine to approve the<br />

Revised Personnel Policy Manual minus the request for President's Day Holiday. The motion<br />

carried 5-0.<br />

ORDINANCES<br />

12. ORDINANCE NO. 992: FIRST READING OF AN<br />

ORDINANCE AMENDING THE CITY OF ARCADIA CODE<br />

OF ORDINANCES TO REPEAL CHAPTER 58; TO ADOPT<br />

A NEW CHAPTER 58; TO ADOPT FLOOD HAZARD<br />

Ordinance No. 992 was read by title only. Mr. Slaughter explained the need for the updated<br />

Ordinance and stated that the City would be working with DeSoto County Building Department.<br />

Marshal Anderson explained this Ordinance is updated for IRS Tax purposes which are completed on<br />

a yearly basis. <strong>Council</strong>man Fink requested letters from the attorney and actuary for his files.<br />

A motion was made by <strong>Council</strong>man Fink and seconded by Deputy Mayor Heine to approve<br />

Ordinance No. 993 at first reading, as presented. The motion carried 5-0.<br />

COMMENTS FROM DEPARTMENTS<br />

14. City Marshal- August 20<strong>13</strong> Report Included in <strong>Packet</strong><br />

Marshal Anderson stated that Mr. Carl McQuay, Code Enforcement Officer, went to Sebring to review<br />

their Code Enforcement procedures. Some of Sebring's Ordinances establish penalties in the early<br />

phases of the procedures. For example: high grass penalty: once a notice is posted you have ten<br />

days to come into compliance, following that the fine immediately begins. <strong>Council</strong> gave consensus<br />

for the Marshal and Code Enforcement to work with the City Attorney to update the City's Code<br />

Enforcement Ordinances.<br />

Mayor Keene asked about the new advertising flags flying on Oak and Highway 17.<br />

Anderson confirmed those are against the law if they are placed in the City right of way.<br />

Mrs. Green stated the move to the Way Building was complete. The Utility and Finance<br />

Department are now secure and the safety issues were addressed. She stated that on<br />

numerous occasions the Police were called and people were escorted from the building.<br />

She added that she had an example tape of a disgruntled customer to play for the<br />

<strong>Council</strong> and warned that children should exit the chambers when played.<br />

She reported that the computer update is nearing the end stage and the Utility staff is<br />

still in training mode. She thanked her staff for assistance during this time. She<br />

reported that staff was able to meet the budget without using reserves. She stated that<br />

she spoke to the Auditor but has not received any further information from Tallahassee.<br />

Mrs. Green played a short tape recording and noted that these type calls occur every<br />

hour of every day.<br />

5. Request for Issuance of a Certificate of Appropriateness and Waiver of Fees for<br />

Installation of Split Rail Fence, Applicant DeSoto County Historical Society (City<br />

Planner)<br />

Mr. Slaughter explained this request was approved by the Historical Preservation<br />

Commission. Staff has determined compliance with zoning and fence permitting<br />

however the applicant, DeSoto County Historical Society (DCHS)-501c3 designated, is<br />

requesting a waiver of fees and staff is asking for direction from <strong>Council</strong>. He responded<br />

to Mayor Keene that the fee is currently $165.00. Mr. Slaughter explained that the<br />

DCHS is merely defining their property and parking spaces with the requested fence<br />

permit.<br />

A motion was made by Deputy Mayor Heine and seconded by <strong>Council</strong>man Fink to<br />

approve the request for an issuance of a Certificate of Appropriateness for the<br />

installation of a split rail fence located at 300 North Monroe Avenue for DeSoto<br />

County Historical Society. The motion carried 5-0.<br />

There was additional discussion regarding the waiver of the fees and <strong>Council</strong><br />

agreed to a waiver of fees on a case by case basis.<br />

A motion was made by Deputy Mayor Heine and seconded by <strong>Council</strong>man Fink to<br />

approve the waiver of fees for the fence permit to DeSoto County Historical<br />

Society in the amount of $165.00. The motion carried 5-0.<br />

6. Prayer Policy (Attorney)<br />

Attorney Wohl stated the proposed Resolution is still under review and staff may look<br />

into alternate measures to inform the public. The item required no action at this time.<br />

Mr. Earnest Morgan stated that no man has a right to infringe upon another's right.<br />

7. Purchasing Policy (Administrator)<br />

Mrs. Jankosky stated that this policy is all encompassing and modeled from the City of<br />

Winter Park. Attorney Wohl has reviewed the policy as well. <strong>Council</strong>man Fink replied it<br />

COMMENTS FROM DEPARTMENTS<br />

<strong>10</strong>. City Marshal<br />

Marshal Anderson explained a crosswalk issue that needs repairing at East Oak Street<br />

and Pasco as requested by the DeSoto County School Board. Marshal Anderson<br />

requested several crosswalks be painted and reported them to Mrs. Jankosky and Mrs.<br />

Miller. He stated that most of the crosswalks were painted except for East Oak Street.<br />

Marshal Anderson met with Mrs. Miller at the intersection of Manatee and Oak Street to<br />

view the crosswalk. He stated that Mrs. Miller told him that it was against Federal ADA<br />

rules to stripe without traffic controllers. At that time he told the School Board to contact<br />

Mrs. Miller directly. Marshal Anderson asked if this is true for that intersection then why<br />

are there painted crosswalks at other intersections, for example, Manatee and<br />

Magnolia. He explained that <strong>Florida</strong> Statutes speak to pedestrian crosswalks and<br />

states that a traffic control sign is a stop sign as well as a yellow flashing school<br />

crossing light. Marshal Anderson replied to Mayor Keene that there is no crossing<br />

guard on Oak Street.<br />

Mrs. Miller stated that when she met with Marshal Anderson she told him that cross<br />

striping has to be controlled or stop signs are required which is Federal Transportation<br />

Standards. <strong>Council</strong> agreed to install stop signs and complete the striping.<br />

Marshal Anderson reported that the Turner family is conducting an event related to a<br />

Gator Reality TV show in <strong>Arcadia</strong>. They wish to film on Saturday, September 21, 20<strong>13</strong><br />

from 8 a.m. to 8:30 a.m. and asked if Oak Street near the Courthouse could be closed<br />

for that period of time. <strong>Council</strong> gave consensus for the request.<br />

Marshal Anderson requested if four (4) confiscated vehicles and four (4) retired vehicles<br />

could be sent to auction at the Lee Civic Center on October 1, 20<strong>13</strong>. <strong>Council</strong> gave<br />

consensus for the auction of the eight (8) vehicles.<br />

Marshal Anderson reported that he felt misinformation may be going around the City.<br />

He explained that the policy in 1993 allowed Officers to take vehicles home if they lived<br />

within DeSoto County. The policy was tweaked when Marshal Lee was in office. He<br />

clarified that no Officer has driven to Sebring or Sarasota. Officers are allowed to utilize<br />

vehicles for attending classes and that is usually located in Polk County.<br />

Mayor Keene stated that the Police presence in the City is well received and the<br />

Department is doing a much better job.<br />

Lt. Joens explained that the Police Department received an anonymous donation from<br />

someone outside of the City which they will utilize to purchase ballistic vests. He will<br />

deliver the check in the amount of $<strong>13</strong>,000 to Finance to place in the Police fund<br />

account.<br />

11 . Attorney<br />

Attorney Wohl reported that he is continuing work on the Special Event and Code<br />

Enforcement Ordinances. The Special Event Ordinance was sent to Mrs. Jankosky and<br />

Code Enforcement for review.<br />

12. City Administrator<br />

a. Smith Brown Gym Update<br />

Mrs. Jankosky reported that the Fire Department inspected the Smith Brown Gym and<br />

asked the City to install an alarm system as well as replacing the entrance doors.<br />

<strong>Council</strong> agreed that Mrs. Valerie Gilchrest be allowed one more food drive at the gym<br />

and <strong>Council</strong> requested a quote to install the alarm and repair the doors.<br />

Mr. Charles Conklin asked if Mrs. Gilchrest will be allowed to extend the permit<br />

previously paid up until December. Mrs. Gilchrest stated she would also reach out to<br />

others (Gulf Coast) for funding. <strong>Council</strong> agreed that her permit could be extended.<br />

Mrs. Beth Carsten questioned what the Prayer Policy was considering. Attorney Wohl<br />

replied that it will only be a procedure and tailored to fit the City of <strong>Arcadia</strong>. Ms. Carsten<br />

replied that <strong>Arcadia</strong> is a God fearing City and she feels the <strong>Council</strong> should have the<br />

freedom to pray and someone in the audience may pray.<br />

Mr. Steve Underwood: "I am here to defend my job. I was terminated a week and half<br />

ago by Mrs. Miller. I've been through four (4) Administrators and I've never done<br />

anything wrong until Mrs. Miller has come on scene. I was written up a total of nine (9)<br />

times in two and half months Mrs. Miller has been here. If you look in my previous<br />

record there is zero. So I leave that with <strong>Council</strong>. Something needs to change and I'm<br />

not here just for myself, I'm here for City employees and the City of <strong>Arcadia</strong>. This needs<br />

to be taken a close look at of people undermining, trying to discredit me and I've done a<br />

good job and if anyone had an issue with me they should have come to me in person.<br />

Not write me up nine (9) times on nine (9) write ups on the day I was terminated that I<br />

knew nothing about. So if you can prove to me something different, I've done that bad of<br />

a job in the 24 years I've been here since October 31st of 1989, prove it to me."<br />

Mayor Keene: "Steve there is a, I here you, I appreciate your comments. I think you've<br />

thrown down the challenge to all <strong>Council</strong>. There is an opportunity for you to go through<br />

an appeal process that's in the personnel manual, outlined in the personnel manual.<br />

Am I correct?"<br />

Mr. Underwood: "If that's the case then how come I wasn't able to read the nine (9)<br />

write ups, two (2) that were shredded by HR in front of me that she couldn't justify."<br />

Mayor Keen: "I don't know."<br />

Mr. Underwood: "Exactly, you don't know. Exactly."<br />

Mayor Keene: "No Sir, let me clear something up then, you've been around here 24<br />

years all right. The <strong>Council</strong> sets policy and does the budget, and we are a strong City<br />

Manager system. That's why in our personnel manual we have an opportunity for an<br />

employee who wants to appeal what's happened to them to come to the CounciL"<br />

Mr. Underwood: "How do you appeal and not to interrupt you Mr. Mayor, how do you<br />

appeal something and the first appeal goes to the first person that terminates you?"<br />

Mayor Keene: "Then you go to the second person. I'm telling you there is a process."<br />

Mr. Underwood: "And I agree <strong>10</strong>0 percent."<br />

Mayor Keene: "Can I speak just a minute, I didn't interrupt you. Give me just a minute.<br />

As I understand it, unless I'm missing something, the personnel policy outlines how to<br />

do this and the buck does stop with the City <strong>Council</strong>. Ok, if you lose your appeal<br />

everywhere else then you are here. I would encourage you to go through the process."<br />

Mr. Underwood: "I have already started that process but there is so much undermining<br />

going on in the City, the process is going to be all for naught."<br />

Mayor: "Weill don't.. .. "<br />

Mr. Underwood: "If I've done that bad of a job in the 24 years I've been here through<br />

four Administrators you would think someone by this time would have told me I've done<br />

that bad of a job, not three Administrators, four Mrs. Jankosky being the fourth. You can<br />

go to my co-workers and anyone you would like to speak to that would back me up<br />

<strong>10</strong>0% that my termination or written reSignation which I've done neither except for I did<br />

appeal it, will back me up <strong>10</strong>0%. Thank you very much."<br />

<strong>Council</strong>woman Frierson: "Weill am going to address the elephant in the room. I think Steve has<br />

a point. How does he use the appeal process when they are the very people that dismissed<br />

him?"<br />

Mayor Keene: "I mean .... how else would it work though Alice? I mean your first person is the<br />

one who dismisses you, if that's the line you come through, that's the way I remember when we<br />

all up here approved the personnel policy, that's the way it would work."<br />

<strong>Council</strong>woman Frierson: "OK, that seems fruitless to me."<br />

Mayor Keene: "Then we need to change the personnel policy."<br />

<strong>Council</strong>woman Frierson: "Also I'd like to say several years ago we started down this road and<br />

that's why I got actively involved. We had long-term employees that were forced out, terminated<br />

forced to retire and the City was a long time recovering from all that and many ways we have<br />

not recovered from it and we are going to start down this road again. I don't think the two<br />

dismissals, I think there is more coming down the road, from em ails and conversations with the<br />

City Administrator I think she has a list. And I think the <strong>Council</strong> should address it."<br />

Deputy Mayor Heine: "It smells to high heaven. I have always been for the employees, always<br />

there's not one in here that can tell me I haven't been. You see people like Steve who repaired<br />

this room that we needed so long ago - repaired it, got it ready with his crew, three people from<br />

the garage department; they took enough of the bull that they went on and resigned. Jerry<br />

didn't' get a chance to resign he was just plain out fired, he was a long time employee. They<br />

told Steve either you resign or be fired, that's holding a gun to a man's head. And in 24 years<br />

not only did he work in this room; he worked in the old highway patrol getting it ready for the<br />

Police Department. He's done wonders, last year alone he maneuvered; he bought four new<br />

pickups for the City and saved $4,000 on each truck. Now you tell me this man hasn't done his<br />

job and if he ain't hired back I'll guarantee he needs to get him a good lawyer and sue hell out of<br />

us."<br />

<strong>Council</strong>man Allen: "Well I think, (audience asks for him to speak directly into microphone) .... I<br />

kind of feel like Mr. Heine, several have come to me and brought letters of retirement or firing<br />

that I think should have a better representation before that happens or during that period of time<br />

and I think <strong>Council</strong> certainly owes that group of employees some attention."<br />

<strong>Council</strong>man Fink: "Well as being one of two that actually read the file concerning this."<br />

<strong>Council</strong>woman Frierson: "I've read the files twice, twice."<br />

<strong>Council</strong>man Fink: "I know you have Mam, and I have the files right here for both and if we are to<br />

believe that this was done in error or because of vendetta then I would suggest to you that we<br />

don't have a problem with what was done as much as how it was done and to whom. And I think<br />

that is problematic in this. I think that what we need to realize is that we have put Administrator<br />

Jankosky in charge as the ultimate hire and fire of the City of <strong>Arcadia</strong>, and if you have a problem<br />

with this, you do not have a problem with Mrs. Miller who is the Director of Public Works; you<br />

have a problem with Mrs. Jankosky. And I would suggest to you that I see nothing in this and<br />

what I read that was not a following of policy. I look at this and I see this and unless they<br />

fabricated these files, and if you're suggesting that in case happened, then we have a far more<br />

serious problem and I suggest to you even further that it's not in our pay grade to get involved in<br />

individual hiring's and firings' and whether or not a friendship is involved in these rather than it's<br />

a straight business decision. All of these things are involved in this. I don't see a problem. I see<br />

a problem in that, yes ok, we've had four Administrators in a number of years, and please allow<br />

me to finish my train of thought before you start to boo or hiss because I'm sure you're not going<br />

applaud. But Just a little over a year ago this <strong>Council</strong> took it upon itself to cost us $25,000 to get<br />

rid of Lawrence Miller, now I would suggest to you that with the paperwork that is involved that<br />

is here and who have seen it, if we do something similar it is going to be a minimum of an<br />

additional $25,000 that we don't have to get rid of this woman and I don't see that she has done<br />

anything that would warrant that and now unless you are going to ... Excuse me, please."<br />

Mayor Keene: "Please <strong>Council</strong>man Fink can I interrupt for a moment. I've asked the Police<br />

Department if we have any folks that can't control themselves I've asked them to escort the<br />

folks out. Let's give our utmost attention to the speaker. I appreciate it and I'm sure <strong>Council</strong> and<br />

the neighbors sitting close to you appreciate and want to hear what we are saying."<br />

<strong>Council</strong>man Fink: "Thank you Mr. Mayor, I appreciate that. I believe if we take the same action<br />

as a <strong>Council</strong> that we did just a little over a year ago we will find ourselves in far more heat than<br />

the $25,000 that we paid out to Dr. Miller. And we don't have that money to spend and I'm not<br />

suggesting that we keep a City Administrator that is inept, but I do not find, again, in reviewing<br />

these documents, this one and this one, that our Administrator has done anything that would<br />

warrant that. Again, unless we find that she has, I just wonder how <strong>Council</strong> Members that<br />

haven't reviewed and Mam I'm not suggesting that you be asked this question but I'm real<br />

concerned as to where you are getting your information from if you are feeling that this is not<br />

justifiable to the <strong>Council</strong> Members that have not read this documentation. Because if you<br />

haven't come in and asked for an overview and you haven't read the documentation then what<br />

the heck are you making your judgment off of? Because you are not getting it but from one<br />

source and I'm not suggesting that is not important, what I'm suggesting to you is she has a<br />

right to be asked as well before any finalization or before anything, before you make a judgment<br />

but apparently a judgment has been made already. Because I have asked has anyone else<br />

reviewed these file, I knew you had read these files, Mam and I commend you for that, I<br />

commend you for doing your homework and due diligence but the rest of the <strong>Council</strong> has not.<br />

And they have not even asked for a summation from the City Administrator."<br />

<strong>Council</strong>woman Frierson: "I not only have read the files but I had four (4) meetings with the City<br />

Administrator that ended very unsatisfactorily. In reading the files the Public Works Director<br />

came on staff on June 25 th . June 2ih she writes Mr. Underwood up. There is usually a<br />

honeymoon period going on here where you get to know each another and personalities.<br />

Apparently there was none of that. It was in your face you're gonna be gone, we are going to<br />

break up the good ole boy system whatever that is. And I just think that it was, it was wrong."<br />

<strong>Council</strong>man Fink: "I don't, that's your feeling on this and I don't have a problem because you<br />

actually did your homework and I do appreciate that, but to make a judgment without doing<br />

homework and to suggest putting someone else's job in jeopardy without doing homework and<br />

you are not doing that."<br />

<strong>Council</strong>woman Frierson: "No I think an employee, if they are going to be written up, they should<br />

have a conference with the Public Works Director and that employee should sign that he<br />

understands what he did wrong. None of those are signed by an employee, none of them. No<br />

there is no notation that this employee has been advised of this whatsoever. They are signed<br />

strictly by the City Administrator and Public Works Director. Not an employee. An employee<br />

was put on a 30-day probationary period and 7 days later he was dismissed. I have a problem<br />

with that."<br />

Mayor Keene: "You know <strong>Council</strong>man Fink .... "<br />

<strong>Council</strong>man Fink: "It is my understanding that refusal to sign such a document, also occurred."<br />

<strong>Council</strong>woman Frierson: "That refused to sign them? That's not what I read at all."<br />

Mayor Keene: "Steve can I say something before you go on?"<br />

Mr. Underwood: "Go on."<br />

Mayor Keene: "Because what has been made so clear is that there are three (3) of us who have<br />

not read this documentation. Thanks for your permission I've got the gavel. I'm running the<br />

meeting."<br />

Mr. Underwood: "You're the man."<br />

Mayor Keene: "Thank you, yeah you bet, I am not for much longer because I think we are<br />

reorganizing at the next meeting that is my understanding, is that correct? I needed to get that<br />

out of the way tonight as well. I had not asked for this, and thank you for yielding to me and you<br />

as well to let me say my piece. I hadn't read this because the way I understood it in the<br />

personnel policy there was a procedure that you went through with this and I didn't think we<br />

were to a point where I needed to be involved in looking at any of this apparently we have fast<br />

forwarded and that's where we are. Ok I guess it's time for the three of us that haven't looked at<br />

this to have a look and maybe put this as an agenda item at the next meeting and let's try to get<br />

to the bottom of this if that's what we think we need to do. Steve I'm not saying that we don't,<br />

I'm not against you on this I'm not against anybody because I haven't done my homework as<br />

<strong>Council</strong>man Fink has said so I can't speak to this at all. If that made any sense to the rest of the<br />

<strong>Council</strong>, does it?"<br />

<strong>Council</strong>man Fink: "And Mayor I didn't mean you because you had not spoken to the issue."<br />

Mayor Keene: "No, no but that's my whole point maybe that is something else I need to<br />

understand. Does everyone understand that we have a personnel policy and people have rights<br />

to appeal what's been done to them?"<br />

Mr. Underwood: "May I address the <strong>Council</strong>? On the day I was terminated I was called into Mrs.<br />

Sandy Vitella's office along with Mrs. Miller and I was presented with, I did not look at all of<br />

them, maybe 4 to 5 reprimands to my knowledge, but I was so in awe of getting terminated did I<br />

look them over? No I didn't because 24 years of service you are thinking ok what did I do so<br />

terribly wrong to deserve these reprimands and I looked briefly through them. Well then 2 to 3<br />

days later I go up there I have additional 7 or 8 reprimands in my file that I knew nothing of on<br />

top of the ones on the day I was terminated. How can I correct a problem in my personnel file or<br />

be verbally written up or physically written up on a piece of paper that I have no knowledge of<br />

until the day I am terminated? There were 2 nd and 3 rd and 4th verbals and written up on things I<br />

wasn't aware of. If I'm not aware of them Mr. Mayor how can I correct them, is my question?"<br />

Mayor Keene: "I don't know. You got me. You got me. What were you reprimanded for? If we<br />

want to get into the discussion we can stay here the rest of the night. But I don't know I haven't<br />

seen anything. I would like to take a look."<br />

Mr. Underwood: "If you look in my previous file before Mrs. Miller came on scene do you know<br />

how many reprimands are in my file in 24 years of service to the City of <strong>Arcadia</strong>? Zero. So I<br />

couldn't have been doing that bad of a job."<br />

Mayor Keene: "I'm not suggesting that you were. Like I said you got me. I don't know I haven't<br />

looked. And you can give me the look all you want."<br />

Mr. Underwood: "I'm fine I back you I back the City of ...... "<br />

Mayor Keene: "I don't understand why this is occurring .... "<br />

Mr. Underwood: "I back the City of <strong>Arcadia</strong> <strong>10</strong>0 %. I gave 24 years of blood, sweat and tears to<br />

the City and this is one thing to speak of that me and my employees done and to be treated the<br />

way I was treated is unacceptable and that's my opinion and that's all I have to say and thank<br />

you very much for City <strong>Council</strong>'s time."<br />

the personnel policy. We want to follow it. I understand the necessity of getting this addressed<br />

as soon as possible. I think we need to consult with them before doing anything. Again this is<br />

outside the scope of my retainer; we do have an employment law attorney that we should<br />

Jeanie Raines, City Employee: "Once again I have been threatened, more rumors I am beyond<br />

tears I hope this time. I am just appalled. I don't have a problem with Mrs. Jankosky; she has<br />

always spoken to me even when I wasn't supposed to be there. Big Daddy, big secret, I did go.<br />

And she invited me in her office and spoke to me. As far as you go to your director of Public<br />

Works and speak to her, you can't, you will be talked over, it is, I don't mind he's my friend, all<br />

these people here have reasons to be here. Jerry is my Big Daddy. He is the best boss, nothing<br />

against Tara, I love you Tara. Don Waters knows I love him and all the other bosses but when<br />

Big Daddy gets mad, it's ten minutes. You understand that? It's fine. It's ten minutes and it's<br />

over and I don't have to walk around sick. I have come to work sick for the last three weeks and<br />

it started when I almost had my house foreclosed. I can understand what Steve is saying. I ain't<br />

had 24 years, I'm sure ya'il can hear me. I'm sorry I'm upset I might cry after all. I've had 11<br />

years. I have never come and asked for a raise in 11 years, my house ..... "<br />

Deputy Mayor Heine: "Hold on, hold on."<br />

Ms. Raines: "My home was being foreclosed, this isn't just a house. My son has lived there<br />

since he was 2 years old, my boyfriend died of cancer in my living room. I explained to this lady<br />

I needed help it didn't even have to be a raise. I needed some sort of help from the City. I've<br />

never come in 11 years, you know what I was explained. I needed to go apply for assistance. I<br />

have a job, a 40 hour a week job, I'm sorry but the way I was raised, as long as you are working<br />

you don't go apply for assistance. I don't apply for assistance when I'm in that ditch behind<br />

Smith Brown Gym, Big Daddy sees to it if it's taking me a little too long and he gives me<br />

assistance. I'm by myself in the ditch, sweating, bleeding, that's my job, I enjoy my job. But I'm<br />

getting off the thing. Not only did I have this problem which I discussed with Ms. Sandy. And I<br />

didn't get to go to Ms. Judi, Sandy made me understand and by the way my shrink did too, they<br />

took our pants away. This is what my shrink Dr. Gallego will be happy to tell you. He explained<br />

to me that I was being silly if they took your pants away what made you think they'd give you<br />

some money. So maybe I was in the wrong there, but I don't believe that woman should have<br />

been able to tell me to apply for assistance. I don't know how many other here have applied, it<br />

ain't that easy. Then we were told that she made a promise that the cemetery would be done in<br />

4 days by 4 people. She made the promise; we were not consulted as far as I know she has<br />

never mowed or weeded in a cemetery. Have any of ya'il mowed or weed eated in a cemetery.<br />

You understand that. Can you imagine 4 people knocking out that entire cemetery in 4 days?<br />

And I was told if it's not done in 4 days heads would roll. Apparently she got angry because she<br />

seen me and Shannon speaking, unless she has some kind special hearing, she don't know<br />

what me and Shannon were talking about, how does she know he didn't need a key for the<br />

gate? How does she know he didn't have a problem in the burn pile? I not only work in the<br />

cemetery not only Smith Brown Gym, I'm up town you've seen me pulling grass, you've seen<br />

me spraying, I'm everywhere I do it all. She took it upon herself to assume I was gossiping<br />

that's how it was later explained. We were supposed to follow the chain of command. Would<br />

you want to approach this person again, if you had been told apply for assistance, if you had<br />

been told your head would roll if you didn't' do an impossible job? No I did not besides I didn't<br />

have her phone number. She said yes, you do, unless she's been sneaking in my phone without<br />

me knowing it. How would she know that with my phone in my pocket? I am angry tonight. I<br />

mean no respect to ya'il and if I get fired for it, I got the paper in my drawer already applied for<br />

the memorandum if I lose my job to keep my house. Big Daddy was done wrong, Steve was<br />

done wrong. No disrespect to you Mr. Fink I'm not a good ole boy, I'm a girl. 11 years I have<br />

she is here somewhere she's a nice lady she calmed me down, she came out when I called the<br />

administration office because I was told from her that I could talk to her at any time. That's<br />

when this woman Mrs. Miller come out and informed me that I did have her number and I said<br />

no Mam I do not. When your number was offered Big Daddy told me not to take it. And I didn't<br />

do it because that is the top of my chain of command that is my boss that is who I listen to. If I<br />

think he is being treated unfairly that is when I went to Ms. Judi because I have been up here<br />

before and I have spoke to Ms. Judi because people were talking about my Big Daddy. And I<br />

told her that's wrong I've never had a problem that I couldn't go to him whether it be work, be<br />

home. I don't want this to go to agenda. They need to come back to work; they need to be there<br />

tomorrow at the very latest Monday. If she can't learn some manners, now she don't want to be<br />

fired. I don't wanna see nobody lose their job, it sucks. I've never been fired but one time many<br />

years ago. I don't want to see her lose her job; I want her to go to school to learn how to talk to<br />

people. She needs to learn it's not ok to come up to someone you don't even know and tell<br />

them to go apply for assistance. I have pride. If I didn't have pride you would not see me in the<br />

ditches working the way I do; you wouldn't see me with weed eaters longer than I am tall,<br />

tractors that I have to climb into. I don't need to apply for assistance, Ms. Sandy at least offered<br />

me a shrink. I already got one of those." Inaudible section<br />

Dr. Dixon: "I didn't know that the subject was coming up tonight. I think what I hear the attorney<br />

saying is that this is an administrative matter rather than a legislative matter. I recall when I was<br />

elected that I was elected to do legislation as a <strong>Council</strong>man as a Deputy Mayor not to deal with<br />

administrative matters. That's what 3 members on this <strong>Council</strong> chose to do when they<br />

undermined and broke laws to get rid of Dr. Miller and hired Mrs. Jankosky our current<br />

Administrator. This is what they asked for; this is what they chose to do those 3 members. I<br />

don't think it was Mayor Keene or Joe Fink, it was Robert Heine, Alice Frierson and an<br />

appointed member, never been elected on <strong>Council</strong> at all and only makes motions to adjourn<br />

meetings, Bob Allen. With that being said, I've always fought and stood up for the employees of<br />

this City when I was on the <strong>Council</strong> and they know this. I'm very disturbed when I hear this man<br />

has been terminated Steve Underwood that is a very serious concern to me when he put 24<br />

years of his heart. I'm going to try to keep it, (inaudible) because it's personal to me as well.<br />

There was a man Steve Rowley, they were the same after working here about 30 years, I was<br />

the member that made the fight and overturned that decision and saved him if ya'il remember.<br />

And not only reinstated him but gave him retroactive pay from the time he was off because I felt<br />

it was totally unfair to take a person that had put so much time and work and take that away<br />

from them like that, they have a family they have children. I think that needs to be looked at but<br />

I'm not the man, Jeanie if you get fired, you had your right to speak, it's your constitutional right.<br />

I promise you the person that fires you will be terminated by me, that is not a threat, and the<br />

citizens of this City because we vote; we put you guys there to do a job and make sure these<br />

employees are taken care of. I've demonstrated what I m saying with that being said, I want to<br />

make it very clear. Mrs. Jankosky, in my opinion, is doing a fine job. I think she's moving us in a<br />

very positive direction even though I'm not a <strong>Council</strong> Member or Vice Mayor and it may be<br />

administrative rather than legislative. I will personally tonight ask for Mrs. Cathy Miller's<br />

resignation and I would hope and pray because no one will stop me from praying to my God,<br />

just suggested that Mr. Attorney I'm not saying your suggesting that and you are doing a pretty<br />

good job, I appreciate your cautioning this <strong>Council</strong> tonight. I don't know Mrs. Miller and you<br />

don't know me, we have met once or twice but you resigned from the County is that correct?"<br />

Mrs. Miller: "Yes, to take this position here."<br />

Dr. Dixon: "You resigned from the County, I don't care why you resigned I'm asking for you to<br />

resign from the City of <strong>Arcadia</strong> and if you don't resign I'm going to do everything in my power, in<br />

my authority to seek for termination and that's where I'm at with it. You guys just please allow<br />

Judi to do her job, follow the policies and the most brilliant thing Heine said tonight was get a<br />

lawyer and sue the hell out them."<br />

Jerry Cordes: "I've been here almost 18 years. I started out with Mr. Strube and Joyce were<br />

here and I'm sure ya'il remember Joyce she wasn't a very nice lady, but we got along and I<br />

have never had any problem with anybody doing whatever was requested. I kinda seen this<br />

coming so I had Ms. Sandy pull my file. I have nothing in my files unless there was something<br />

put in there after about a week ago. No write ups no nothing and she tells me I'm insubordinate<br />

and I'm not doing my job. How can I do my job when she changes it every day, if I start here she<br />

wants me to start over here, if start over here she wants me to start over here. And I'm sorry<br />

she done run off 4 or 5 people that were good people over garbage. And she wants me to do<br />

things that I don't feel right doing myself most of my people are here, my ex-people. I can't lie to<br />

them and tell them they are going to get extra money or get a raise that's up to you people. I<br />

can't promise they are going to get a .50 cent raise because I don't have that authority. I don't<br />

tell them what they want to hear I tell them what I know. I think I was wrongfully terminated and<br />

I've been doing that job for quite a while and I've never had any problems before and I don't<br />

have a write up in my file. Thank you."<br />

All special events require a SPECIAL EVENT PERMIT. Event organizers shall obtain a Special<br />

Event Permit application from the City Administrator's office, to be returned to that office at<br />

least thirty (30) days prior to the anticipated date of the event. Any required documentation or<br />

attachments should be included with the application. The completed application must include<br />

legible information detailing: .<br />

a. A narrative describing the approximate number of people expected to attend,<br />

b. Whether signs will be placed in the city rights-of-way,<br />

c. Any special or unusual circumstances (cooking, alcoholic beverages, wildlife,<br />

fireworks, carnival type rides, outdoor music, etc.)<br />

d. Indicate whether additional electric service will be required, and if so where.<br />

e. Whether streets will be closed, or barricades erected.<br />

f. Include details of traffic control, emergency access and parking arrangements.<br />

g. Describe the provisions made for collection of trash, garbage & recycling.<br />

h. If applicable, specify the location and indicate whether or not you have the.<br />

owner's permission to hold the event at that location and provide owner's {!<br />

contact information.<br />

The event sponsor will be responsible for any cost incurred by the City for set-up or clean-up of<br />

the event, and any security provided by on-duty law enforcement. The sponsor will have the<br />

option of prOviding its own security, at its own cost, through a private security company or offduty<br />

officers.<br />

All special events are subject to final approval by the City Administrator, Police Department<br />

and possibly the City <strong>Council</strong>.<br />

INSURANCE - The event organizer shall provide proof of liability insurance coverage naming<br />

the City as an additional insured on the Comprehensive General Liability Policy. An<br />

Indemnification and Hold Harmless Agreement must be signed by an authorized representative<br />

of the organizing group and submitted along with the Certificate of Insurance and application<br />

packet.

AMENDMENT TO SPECIFIC AUTHORIZATION NO. 16<br />

General Consulting Services<br />

THIS DOCUMENT, executed this __ day of<br />

,20<strong>13</strong>, is an Amendment to<br />

Specific Authorization No. 16 dated October 16, 2012 which was issued under the Agreement for<br />

Professional Services dated September 7, 20<strong>10</strong> (hereinafter called the "AGREEMENT"), between the<br />

City of <strong>Arcadia</strong>, a <strong>Florida</strong> municipal corporation (hereinafter called "OWNER") and Hazen and Sawyer,<br />

P.C. (hereinafter called "ENGINEER").<br />

WHEREAS, the AGREEMENT provides that the OWNER may authorize the ENGINEER, by Specific<br />

Authorization, to perform professional services;<br />

WHEREAS, the OWNER desires the ENGINEER to continue to provide engineering services related to<br />

the utility system including the water and wastewater treatment plants, distribution and collection system<br />

and stormwater system as well as to provide general engineering assistance with other utility matters as<br />

they arise.<br />

SCOPE OF SERVICES<br />

Therefore, the ENGINEER has agreed to continue to provide General Consulting Services which may not<br />

all be defined at the present time but may include the following task:<br />

Task 1 - Review monthly discharge monitoring reports submitted to FDEP on monthly basis.<br />

Task 2 - Assist City with compliance issues associated with the Utility system.<br />

Task 3 - Assist City with preparation of regulatory reports associated with their wastewater, stormwater<br />

and water systems.<br />

Task 4 - Provide engineering assistance with utility review of FDOT roadway plans that impact City<br />

utilities.<br />

Task 5 - Provide permitting and funding assistance associated with the improvements to the utility<br />

system.<br />

Task 6 - Provide GIS, modeling and planning assistance with distribution and collection system.<br />

Task 7 - Provide other general engineering assistance to the OWNER as requested on a wage plus<br />

multiplier basis.<br />

Task 8 - Provide monthly status report that summarizes work completed.<br />

If accepted by the ENGINEER, specific services to be performed are to commence upon receipt of an oral<br />

01' written request to perform General Consulting Services from the City Administrator, provided any such<br />

oral notification is confirmed to ENGINEER in writing within seventy-two (72) hours. Services to be<br />

rendered under this Specific Authorization are provided in accordance with Articles 3 and 4 of the<br />

Amendment to SA 16<br />

AGREEMENT. It is understood and agreed that the nature, scope, and schedule for the services to be<br />

provided is not defined at present; therefore, the actual services provided for the budget established below<br />

cannot be defined. Payment of invoices rendered pursuant to this Specific Authorization shall constitute<br />

OWNER's acceptance of the services provided.<br />

TIME SCHEDULE<br />

Services described herein will commence upon receipt by Hazen and Sawyer of this executed Specific<br />

Authorization. It is anticipated that the work for this project will be completed and submitted in<br />

accordance within an agreed upon schedule by OWNER.<br />

COMPENSATION<br />

The ENGINEER shall be paid in accordance with the Direct Labor Costs Times a Factor as set forth in<br />

Article 5.1.1 of the AGREEMENT. A budget of $50,000 for services under this Amendment to Specific<br />

Authorization 16 has been established, resulting in a total budget of $75,000 for Specific Authorization<br />

16. This amount will not be exceeded without the OWNER's written approval and an approved<br />

amendment.<br />

OTHER PROVISIONS<br />

All applicable portions of Sections 3 through 6 of the AGREEMENT not specifically modified herein<br />

shall remain in full force and effect and are incorporated by reference herein.<br />

Other Tenns:<br />

If at any time the loan is detennined not to be a taxexempt<br />

loan, the interest rate shall be increased to<br />

4.00% per annum, retroactive to the date interest on<br />

the loan first ceased to be tax exempt. If at any time<br />

the loan is determined not to be "bank qualified,"<br />

the interest rate shall be increased to that rale which<br />

would result in the same taxable equivalent yield to<br />

the Bank, retroactive to the date of issuance.<br />

The final documents relating to the loan will include<br />

other covenants, terms and closing conditions as are<br />

customarily required by the Bank for similal' transaction,<br />

including but not limited to cross-default with other debt<br />

of the City to the Bank, default rate, late payment rate,<br />

events of default and remedies, increase in the interest<br />

rate on the loan in the event of changes in tux law or<br />

capital adequacy requirements, ancl waiver of jury trial.<br />

The City will be required to continue to maintain its<br />

"core deposits" with the Bank for the life of the<br />

loan.<br />

Pensions<br />

DISCUSSION: The general employee pension year end is December 31. To prepare an<br />

actuarial report and try to close out by December 31 probably would not happen because funds<br />

are in two different accounts - USI and AETNA and AETNA would not likely be able to close<br />

out by December 31. This would mean we would have to do another actuarial report in January<br />

and that is not cost effective. Because of this we should wait until after year end to look into<br />

pension reform for the general employee pension. The city already has available a deferred comp<br />

plan with VALlC and Sandy (HR) is working on opening a 401 KIA plan with them as well so<br />

general employees and retirees have options in the future.<br />

The po lice/fire pension year end was September 30. We are in the start of a new year so it would<br />

be good timing to explore the three options our pension attorney laid out. Foster and Foster<br />

which is the actuary for the police/fire pension has quoted a cost of $8,000 to prepare a report that<br />

provides data for all three options. They would start this report once the pension board approves<br />

the October 1, 20<strong>13</strong> actuarial valuation report. Once the report is complete it will provide you<br />

the financial information you will need to determine the most efficient and cost effective manner<br />

in reforming the pension. In the meantime, we can have staff gathering information about<br />

enrolling in the FRS if you would like that information as well.

WHEREAS, on April 2, <strong>15</strong><strong>13</strong>, Spanish explorer Juan Ponce de Leon landed on the east coast of <strong>Florida</strong><br />

and became the first recorded European to set foot on the continental United States of America, predating European<br />

settlement in Jamestown, VA., and Plymouth Rock, Mass., by 94 years and <strong>10</strong>7 years, respectively; and<br />

WHEREAS, 500 years ago <strong>Florida</strong> was given the name "La <strong>Florida</strong>" by Juan Ponce de Leon because<br />

of its lush plant life and in honor of Pascua <strong>Florida</strong>, the Eastertime Feast of Flowers taking place in Spain at the<br />

time of his arrival; and<br />

WHEREAS, the 500th anniversary of Ponce de Leon's landing is a fitting time to reflect on <strong>Florida</strong>'s<br />

dynamic culture, rich diversity and economic prosperity; and<br />

WHEREAS, five flags have flown over <strong>Florida</strong> in as many centuries and <strong>Florida</strong> has been home to<br />

Native Americans for at least 12,000 years; and<br />

WHEREAS, this landmark 500-year anniversary is being commemorated throughout the state in 20<strong>13</strong><br />

with an initiative called "Viva <strong>Florida</strong> 500," which celebrates the important contributions of every community<br />

to <strong>Florida</strong>'s rich history and diverse heritage throughout the past 500 years; and<br />

WHEREAS, the <strong>Florida</strong> League of Cities partnered with the state to launch a campaign, "History<br />

Happened Here," to highlight the rich history of <strong>Florida</strong>'s cities, towns and villages; and<br />

WHEREAS, the <strong>Florida</strong> League of Cities developed an interactive map, located on the official Viva<br />

<strong>Florida</strong> 500 website, that allows visitors to click on any city to learn about its history, see historical photos and,<br />

in some cases, watch a brief video; and<br />

WHEREAS, a "History Happened Here" toolkit was developed to help municipalities plan Viva <strong>Florida</strong><br />

500 activities; and<br />

WHEREAS, this campaign's success depends upon the participation of <strong>Florida</strong>'s cities, towns and<br />

villages; and<br />

WHEREAS, "History Happened Here" offers an opportunity for municipalities to generate tourism and<br />

to engage citizens by celebrating the unique history of <strong>Florida</strong>'s local communities.<br />

NOW, THEREFORE, BE IT RESOLVED BY THE FLORIDA LEAGUE OF CITIES, INC.:<br />

Section 1. That 20<strong>13</strong> is designated "Viva <strong>Florida</strong> 500 Year," and that all Floridians are encouraged to<br />

recognize and commemorate <strong>Florida</strong>'s 500 years of European history and cultural diversity.<br />

Section 2. That <strong>Florida</strong>'s cities, towns and villages are encouraged to highlight their unique local history<br />

and develop and promote local Viva <strong>Florida</strong> 500 events to engage citizens in celebrating <strong>Florida</strong>'s rich history.<br />

A RESOLUTION OF THE FLORIDA LEAGUE OF CITIES, INC. COMMENDING THE<br />

FLORIDA ASSOCIATION OF CITY CLERKS FOR ITS 40TH ANNIVERSARY.<br />

WHEREAS, the <strong>Florida</strong> Association of City Clerks (FACC) was established in 1972 to promote and<br />

develop the educational and professional status of <strong>Florida</strong> city clerks; and<br />

WHEREAS, the FACC works in conjunction with the International Institute of Municipal Clerks; and<br />

WHEREAS, the primary objective of the FACC is to educate the city clerks in the State of <strong>Florida</strong>; and<br />

WHEREAS, the FACC strives to help increase the efficiency of city clerk functions, increase cooperation<br />

and assistance with city administrators, gather and disseminate information to improve procedures, and improve<br />

the efficiency of the administration of municipal government; and<br />

WHEREAS, the FACC currently has 560 members spread out over six districts throughout the state; and<br />

WHEREAS, the FACC is proud to have the second largest certification program in the country with<br />

more than 238 Certified Municipal Clerks and <strong>10</strong>2 Master Municipal Clerks; and<br />

WHEREAS, the <strong>Florida</strong> League of Cities has served as administrator for the FACC for the last 40<br />

years, providing professional and support services to the FACC; and<br />

WHEREAS, the FACC provides educational opportunities for clerks through its annual summer and<br />

fall academies, webinars, district mini-academies; and Athenian Dialogues; and<br />

WHEREAS, the FACC provides a discussion forum by which members may post inquiries when<br />

researching best practices for hot button issues; and<br />

WHEREAS, the year 20 <strong>13</strong> is the 40th anniversary ofthe FA£C, which is an occasion worthy of special<br />

recognition.<br />

A RESOLUTION OF THE FLORIDA LEAGUE OF CITIES, INC. URGING THE OBAMA<br />

ADMINISTRATION AND CONGRESS TO PRESERVE THE CURRENT TAX-EXEMPT<br />

STATUS OF MUNICIPAL BONDS AND REJECT ANY PROPOSAL THAT WOULD<br />

REDUCE OR ELIMINATE THE FEDERAL TAX EXEMPTION ON INTEREST EARNED<br />

FROM TAX-EXEMPT MUNICIPAL BONDS.<br />

WHEREAS, since 19<strong>13</strong>, when the federal income tax was imposed, the interest earned on municipal<br />

bonds has been exempt from federal taxation; and<br />

WHEREAS, municipal bonds have been the primary method by which state and local governments<br />

finance public capital improvements and infrastructure construction such as schools, hospitals, water and sewer<br />

systems, roads, highways, utilities, public safety structures, bridges, tunnels and other infrastructure projects; and<br />

WHEREAS, the projects funded through municipal financing are engines of job creation and economic<br />

growth; and<br />

WHEREAS, according to national statistics, state and local governments are responsible for building<br />

and maintaining more than 75 percent of the nation's infrastructure, which is financed mostly by tax-exempt<br />

municipal bonds; and<br />

WHEREAS, on average, state and local governments save up to two percentage points on their borrowing<br />

rates through the use of tax-exempt municipal bonds; and<br />

WHEREAS, these savings allow state and local governments to invest more in critical infrastructure<br />

and essential services and provide construction jobs while holding down the cost to taxpayers; and<br />

WHEREAS, earlier this year, a joint report titled "Protecting Bonds to Save Infrastructure and Jobs<br />

20<strong>13</strong>" was issued by the U.S. Conference of Mayors, the National League of Cities, and the National Association<br />

of Counties, with assistance from the Government Finance Officers Association; and<br />

WHEREAS, the report estimates that 1,250 tax-exempt bonds financing more than $<strong>10</strong>3 billion in<br />

infrastructure improvements were issued over the last decade in the State of <strong>Florida</strong>; and<br />

WHEREAS, the report also states that in 2012 alone, more than 6,600 tax-exempt bonds financed more<br />

than $179 billion in infrastructure projects across the nation; and<br />

WHEREAS, several proposals have been discussed over the last year as Congress and the Obama<br />

Administration seek ways to reduce the federal deficit; and<br />

WHEREAS, many of these proposals have included a proposed reduction or elimination of the current<br />

tax exemption on interest earned from tax-exempt municipal bonds; and<br />

WHEREAS, in his fiscal year 2014 budget proposal, President Obama has proposed to cap the tax<br />

exemption of municipal bonds at 28 percent; and<br />

WHEREAS, it is estimated that if the 28 percent cap on interest earned from tax-exempt municipal<br />

bonds was in effect over the last decade, it would have cost state and local governments an additional $173<br />

billion in interest expense; and<br />

WHEREAS, it is estimated that if the tax exemption had been fully eliminated over the last decade, it<br />

would have cost state and local governments an additional $495 billion interest expense; and<br />

WHEREAS, 20 1 0 Internal Revenue Service data shows that 57 percent of municipal bond interest is paid<br />

to individuals 65 years of age and older who in many cases live on fixed incomes, and 52 percent of municipal<br />

bond interest is paid to individuals who earn less than $250,000 armually.

TO PASS LEGISLATION THAT WOULD GRANT STATES THE AUTHORITY TO<br />

COMPEL ONLINE AND CATALOG RETAILERS TO COLLECT SALES TAX.<br />

WHEREAS, the use of the Internet as a way to purchase goods and services has been steadily increasing<br />

for the past decade; and<br />

WHEREAS, as the result of court decisions and congressional inaction, many online and catalog retailers<br />

currently are not obligated to collect sales taxes from consumers; and<br />

WHEREAS, this tax loophole is unfairly advantageous toward online and catalog retailers and results<br />

in both the loss of tax revenue for state and local governments and market conditions that are unfavorable for<br />

Main Street and "brick and mortar" small businesses; and<br />

WHEREAS, the Streamlined Sales Tax Project was created in 1999 to assist states in administering a<br />

simpler and more uniform sales and use tax system; and<br />

WHEREAS, to date, 44 states, including <strong>Florida</strong>, have approved the Streamlined Sales and Use Tax<br />

Agreement (SSUTA), which sets the minimum sales and use tax statutory simplifications required of any state<br />

desiring to participate in the simplified system and minimizes cost and administrative burdens on retailers; and<br />

WHEREAS, 24 of those states, not including <strong>Florida</strong>, have modernized their sales and use tax statutes<br />

to conform to the requirements of the SSUTA; and<br />

WHEREAS, bipartisan legislation has been proposed in Congress providing states that are members<br />

of the SSUTA and in compliance with the federal legislation with the authority to require online and catalog<br />

retailers to collect and remit sales and use taxes on remote transactions attributa'ble to sales in those states; and<br />

WHEREAS, earlier this year, the U.S. Senate passed S. 743, titled the Marketplace Fairness Act of<br />

20<strong>13</strong>; however, there has been no action on similar legislation, H.R. 684, in the U.S. House of Representatives.<br />

NOW, THEREFORE, BE IT RESOLVED BY THE FLOlUDA LEAGUE OF CITIES, INC.:<br />

Section 1. That the <strong>Florida</strong> League of Cities, Inc. urges <strong>Florida</strong>'s congressional delegation to support<br />

bipartisan legislation that would provide states the authority to enforce state and local sales and use tax laws in<br />

a fair and equitable manner to both in and out of state retailers.<br />

Section 2. That the <strong>Florida</strong> League of Cities, Inc. urges the State of <strong>Florida</strong> to conform with the SSUTA<br />

so that it may be eligible to comply with federal legislation on streamlining the sales and use tax.<br />

A RESOLUTION OF THE FLORIDA LEAGUE OF CITIES,INC. URGING CONGRESS<br />

TO MAINTAIN FUNDING FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT<br />

PROGRAM.<br />

WHEREAS, the Community Development Block Grant (CDBG) program was enacted and signed into<br />

law by President Gerald Ford as the centerpiece of the Housing and Community Development Act of 1974; and<br />

WHEREAS, the CDBG program has as its primary objective "the development of viable urban<br />

communities, by providing decent housing and a suitable living environment and expanding economic<br />

opportunities, principally for persons of low and moderate income"; and<br />

WHEREAS, the CDBG program has considerable flexibility to allow municipalities to carry out activities<br />

that are tailored to their unique affordable housing and neighborhood revitalization needs; and<br />

WHEREAS, the National League of Cities, the U.S. Conference of Mayors, the National Association<br />

of Counties, and state and local government-sector associations are unanimous in their support of CDBG and<br />

the need to keep this program intact; and<br />

WHEREAS, according to the U.S. Department of Housing and Urban Development, CDBG is most<br />

commonly used to support activities that improve the quality oflife in communities; to promote energy conservation<br />

and renewable energy resources; for construction of and improvements to public infrastructure such as streets,<br />

sidewalks, and water and sewer facilities; and for small business assistance to spur economic development and<br />

job creation/retention; and<br />

WHEREAS, as a result of sequestration, CDBG was funded at $3 billion for fiscal year 20<strong>13</strong>; and<br />

WHEREAS, since 20<strong>10</strong>, Congress has cut CDBG funding by more than $1 billion; and<br />

WHEREAS, <strong>Florida</strong>'s local governments received almost $<strong>13</strong>0 million in CDBG grants in fiscal year<br />

20<strong>13</strong> to catalyze or support employment, housing and neighborhood revitalization efforts; and<br />

WHEREAS, nationally, every dollar of CDBG funding a municipality receives leverages an additional<br />

.(<br />

$1.62 in non-CDBG funding that connects private sector growth to the revitalization of entire communities; and<br />

WHEREAS, the fiscal year 2014 U.S. House Transportation, Housing and Urban Development (T-HUD)<br />

Appropriations bill proposed to cut CDBG funding by nearly 50 percent to $1.6 billion; and<br />

WHEREAS, the U.S. House proposal was $<strong>10</strong> billion less than the T-HUD appropriations bill in the<br />

U.S. Senate.<br />

REDI Municipalities Law Enforcement Services Special Assessment<br />

DISCUSSION: Cities in Broward County had approached there legislative delegates about a<br />

special act of legislation that would provide those cities only with the ability to implement a Law<br />

Enforcement Services Special Assessment. We received an email a few months ago from the<br />

<strong>Florida</strong> League of Cities asking if other cities would be interested in this assessment. <strong>Council</strong>man<br />

Keene and I attended the Desoto County Legislative Delegation meeting last week and planted<br />

the seed with Senator Galvano and Representative Albritton. I have put together a draft bill that<br />

would provide for cities that are within REDI counties the ability to implement the LE special<br />

assessment. Just REDI cities were chosen as we have an economic disadvantage over the larger<br />

cities and this would help us compete with them by being able to reduce our millage while still<br />

maintaining a police department. Police departments are considered an asset and developers<br />

prefer cities that have a police department.<br />

In a nutshell, it would only be for REDI cities because we have, no-doubt-about-it, an economic<br />

disadvantage to big cities with money. To provide this assessment to all cities would just<br />

perpetuate our economic disadvantage as it would allow "rich" cities to reduce their millage as<br />

well thus killing our chances at enticing development to our cities. REDI communities need an<br />

incentive in reduced property taxes, while still paying our bills (funding our police) in a FAIR<br />

manner by collecting the assessment, as EVERYONE pays assessments, not just those with<br />

higher property values.<br />

To implement the law enforcement special assessment the city would have to reduce its millage<br />

by 50% of the collected special assessment amount the first year, and additional 25% the second<br />

year and the final 25% the third year. At no time would a city be required to reduce its millage<br />

more than it collected from the special assessment; however, it could it if chooses to.<br />

Example: Projected ad valorem is $1,454,000. Law Enforcement Special Assessment<br />

collected $1,250,000<br />

The city would be required to reduce their ad valorem collect by $625,000 the first year<br />

(1,250,000 x 50%). The city would set its millage to collect $829,000 ($1,454,000-625,000)<br />

The second year the projected ad valorem is $845,000 (yay, values went up). The city would be<br />

required to reduce their ad valorem collected by an additional $312,500 ($1,250,000 x 25%). The<br />

city would set its millage to collect $532,500 ($845,000-312,500)<br />

The third year the projected ad valorem is $592,000 (values are increasing faster as millage goes<br />

down). The city would be required to reduce their ad valorem collected by the final 25% of the<br />

$1,250,000 collected. The city would set its millage to collect $279,500


Likewise: Projected ad valorem is $1,439,000 LE Special Assessment collected is $1,540,000<br />

The city would be required to reduce their ad valorem by $770,000 ($1,540,000 x 50%) the first<br />

year. Setting the millage to collect $669,000 ($1,439,000 -770,000).<br />

The second year the projected ad valorem is $724,000. The city would be required to reduce their<br />

ad valorem by an additional $385,000 ($1,540,000 x 25%). The city would set its millage to<br />

collect $339,000 ($724,000 - $385,000).<br />

The third year the projected ad valorem is $424,000. The city would be required to reduce their<br />

ad valorem by the final 25% of the $1,540,000 collected. The city would set its millage rage to<br />

collect $39,000 or it could reduce it to zero (0) if it chose to.<br />

Any future increases in the millage would have to follow the <strong>Florida</strong> Statutes. Any future<br />

increase in the special assessment would have to become revenue neutral within three years of the<br />

increase. Any decrease in the special assessment would have no effect on the ad valorem/millage<br />

and increases to the millage may continue to take place per the <strong>Florida</strong> Statutes.<br />

The graduated decrease will help the city put a little money away over a few years but in three<br />

years it would be revenue neutral. We can tie this to REDI because it is an economic<br />

development incentive.<br />

It is recommended that we also send this in resolution form to the <strong>Florida</strong> League of Cities along<br />

with the other resolutions that you chose to support.


A bill to be entitled<br />

An act relating to municipalities designated as Rural Economic<br />

Development Initiative (REDI) cities; authorizing municipalities designated<br />

as REDI cities to levy special assessments to fund law enforcement services;<br />

providing legislative findings of special benefit to real property justifying<br />

the special assessment for law enforcement services; providing for a<br />

reduction in ad valorem taxes when a law enforcement special assessment<br />

is levied pursuant to this act; providing an effective date.<br />

Be It Enacted by the Legislature of the State of <strong>Florida</strong>.<br />

Section 1. Legislative Findings. Rural Economic Development Initiative is defined in<br />

Section 288.0656(1)(a), <strong>Florida</strong> Statutes, as rural communities and regions that continue to face<br />

extraordinary challenges in their efforts to significantly improve their economies, specifically in terms of<br />

personal income, job creation, average wages, and strong tax bases, it is the intent of the Legislature to<br />

encourage and facilitate the location and expansion of major economic development projects of<br />

significant scale in such rural communities. It is further found that these rural communities and regions<br />

have been adversely affected by an extraordinary economic event, severe or chronic distress, natural<br />

disaster or that present a unique economic development opportunity of regional impact. The<br />

municipalities within the following counties are currently REDI communities Baker, Bradford, Calhoun,<br />

Columbia, DeSoto, Dixie, Flagler, Franklin, Gadsden, Gilchrist, Glades, Gulf, Jefferson, Hendry, Hamilton,<br />

Hardee, Highlands, Holmes, Jackson, Lafayette, Levy, Liberty, Madison, Nassau, Okeechobee, Putnam,<br />

Suwannee, Taylor, Union, Wakulla, Washington, and Walton, as amended in the future by the Governor.<br />

It is further found, that law enforcement is a vital municipal service as it protects both persons and<br />

property from crime. In rural areas property crimes include burglary, vandalism, trespassing, arson, and<br />

others have a dramatic impact on property owners and the value of real property in the community,<br />

many times leaving blight. Law enforcement services work to prevent these significant property crimes,<br />

and thus prevent the loss of property values and blight. Moreover, after a property crime occurs, law<br />

enforcement efforts to solve such crimes prevent additional property crimes from occurring in the<br />

community. Finally, law enforcement provides protection for unoccupied properties and prevents<br />

additional losses to property owners, especially in times of economic distress. As a result, the legislature<br />

finds that there is a logical relationship between law enforcement services attributable to the protection<br />

of real property and the prevention of real property crimes and the economic development benefit to<br />

real property to prevent such crimes and ultimate loss in the value of the real property due to crime.<br />

Section 2. Municipalites in REDI communities may fund the cost of law enforcement<br />

services, in whole or in part, through the levy of a law enforcement services special assessment provided<br />

that the governing body ofthe municipality:<br />

(a) Adopts a law enforcement services assessment ordinance that authorizes the special<br />

assessment, and requires that it be levied by resolution each year, and which apportions such


assessable costs among the property based on a methodology that charges a parcel in<br />

reasonable proportion to its benefits; and<br />

(b) The special assessment assessed against each parcel shall not be adjusted more often than<br />

every three years.<br />

(c) In the initial year of implementation, reduces its total ad valorem revenuer as projected for the<br />

upcoming fiscal year and calculated as if there were no law enforcement services assessment,<br />

by an amount equal to the amount equal to the amount of the law enforcement services<br />

assessment, except that no municipality shall be required to reduce its millage rater excluding<br />

millage approved by a vote of the electors and millage pledged to repay bonds, by more than<br />

50% (fifty percent). In the second year of implementation, excluding millage approved by a<br />

vote of the electors and millage pledged to repay bonds, reduces its total ad valorem revenue by<br />

an additional 25% of the special assessment. In the third year of implementation, excluding<br />

millage approved by a vote of the electors and millage pledged to repay bonds, reduces its total<br />

ad valorem revenue by the final 25% of the special assessment. At no time shall a municipality<br />

be required to reduce their millage more than what is collected in law enforcement services<br />

assessments. Thereafter said assessment shall be increased only in such manner as ad valorem<br />

revenue is permitted to be increased pursuant to s. 200.065(5) F.s.<br />

(d) Each subsequent three year period will be required to implement section 2(e) to bring any<br />

increases in the assessment to a revenue neutral position. Reductions in the special assessment<br />
