Abstract

The present invention provides nucleotide sequences encoding an insecticidal protein exhibiting lepidopteran inhibitory activity, as well as a novel insecticidal protein referred to herein as a Cry1A.105 insecticide, transgenic plants expressing the insecticide, and methods for detecting the presence of the nucleotide sequences or the insecticide in a biological sample.

Claims

AMENDED CLAIMS received by the International Bureau on 01 May 2007 (01.05.2007)What is claimed is:
1. An isolated polynucleotide encoding an insecticidal protein comprising an amino acid sequence as set forth in SEQ ID NO:2 from amino acid position IQ through amino acid position 600,
2. The isolated polynucleotide of Claim 1 selected from the group consisting of SEQ ED NO: I and SEQ ID NO:3.
3. The isolated polynucleotide of Claim 2 for use in expressing said insecticidal protein in a crop plant.
4. The isolated polynucleotide of Claim 3 wherein said crop plant is selected from the group consisting of a monocotyledonous crop plant and a dicotyledonous crop plant.
5. The isolated polynucleotide of Claim 4 wherein said monocotyledonous plant is selected from the group of plants consisting of corn, wheat, oat, rice, sorghum, miio, buckwheat, rye, grass (fescue, timothy, brome, orchard, St. Augustine, Bermuda, bentgrass), and barley.
6. The isolated polynucleotide of Claim 4 wherein said dicotyledonous plant is selected from the group of plants consisting of alfalfa, apple, apricot, asparagus, bean, berry, blackberry, blueberry, canola, carrot, cauliflower, celery, cherry, chickpea, citrus tree, cotton, cowpea, cranberry, cucumber, cucurbit, egg plant, fruit tree, grape, lemon, lettuce, linseed, melon, mustard, nut bearing tree, okra, orange, pea, peach, peanut, pear, plum, potato, soybeans, squash, strawberry, sugar beet, sunflower, sweet potato, tobacco, tomato, turnip, and vegetable.
7. An isolated and purified insecticidal protein comprising an amino acid sequence as set forth in SEQ ID NO: 2 from amino acid position 10 through amino acid position 600.

8. A composition comprising an insecticidally effective amount of the isolated and purified protein of Claim 7.
9. An expression cassette for use in expressing an iπsecticidal prorein having an amino acid sequence as set forth in SEQ ID NO;2 in a host cell, wherein said expression cassette comprises in operable linkage a promoter sequence functional in said host cell and a polynucleotide encoding said protein,
10. The expression cassette of Claim 9 wherein said host cell is selected from the group consisting of a bacterial cell, a fungal cell, a mammalian cell, and a plant cell.
1 1. The expression cassette of Claim 10 wherein
(a) said bacterial cell is selected from the group consisting of a Bacillus species cell, a Enierobacteriacae species cell, a Pseudomonas species cell, a Closϊridium species cell, and a Rhizobium species cell, and a Agrobaaerium species cell; and
(b) said plant cell is selected from the group of plants consisting of a dicotyledonous plant and a monocotyledonous plant, said dicotyledonous plant being further selected from the group consisting of alfalfa, apple, apricot, asparagus, bean, beiry, blackberry, blueberry, canola, carrot, cauliflower, celery, cherry, chickpea, citrus tree, cotton, cowpea, cranberry, cucumber, cucurbit, egg plant, fruit tree, grape, lemon, lettuce, linseed, melon, mustard, nut bearing tree, okra, orange, pea, peach, peanut, pear, plum, potato, soybeans, squash, strawberry, sugar beet, sunflower, sweet potato, tobacco, tomato, turnip, and vegetable, and said monocotyledonous plant being further selected from the group consisting of corn, wheat, oat, rice, sorghum, milo, buckwheat, rye, grass (fescue, timothy, brome, orchard, St, Augustine, Bermuda, bentgrass), and barley.
12. The expression cassette of Claim 9 wherein said host cell is a plant cell and said expression cassette further comprises in operable linkage a polynucleotide selected from the group consisting of art expression enhancer sequence, an untranslated leader sequence, an tntron sequence, a chloroplast iargeting peptide encoding sequence, and a transcription termination and polyadenylation sequence,
13. A vector comprising the expression cassette of any of Claims 9 through Claim 12.

A transgenic plant or plant cell resistant to lepidopteran insect infestation comprising a polynucleotide encoding a protein exhibiting an amino acid sequence as set forth in SEQ ID NO:2 from amino acid position 10 through amino acid position 600, wherein said protein exhibits insecticidal activity when expressed in said plant or plant cell.
15. The transgenic plant or plant cell of claim 14 wherein said transgenic plant is selected from the group consisting of a dicotyledonous plant and a monocotyledonous plant, said dicotyledonous plant being further selected from the group consisting of alfalfa, apple, apricot, asparagus, bean, berry, blackberry, blueberry, canola, carrot, cauliflower, celery, cherry, chickpea, citrus tree, cotton, cowpea, cranberry, cucumber, cucurbit, egg plant, fruit tree, grape, lemon, lettuce, linseed, melon, mustard, nut bearing tree, okra, orange, pea, peach, peanut, pear, plum, potato, soybeans, squash, strawberry, sugar beet, sunflower, sweet potato, tobacco, tomato, turnip, and vegetable, and said monocotyledonous plant being further selected from the group consisting of corn, wheat, oat, rice, sorghum, milo, buckwheat, rye, grass (fescue, timothy, brome, orchard, St. Augustine, Bermuda, bentgrass), and barley.
16. The transgenic plant or plant cell of claim 15 resistant to lepidopteran insect infestation, wherein said lepidopteran insect is selected from the group consisting of a leaf roller, a cutworm, an armywoπn, a borer, a bagworm, and a forage feeder.
17. The transgenic plant or plant cell of claim 16, wherein said lepidopreran insect is further selected from the group consisting of a fall armyworm, a European com borer, a corn earworm or cotton bollworm, a southwestern corn borer, and a black cutworm.
18. Progeny or seed of the transgenic plant or plant cell of claim 15, wherein said progeny or seed comprise said polynucleotide.
19. A method for controlling lepidopteran insect infestation of a plant by providing in lhe diet of the insect one or more plant cells transformed with a nucleic acid comprising in operable linkage a plant functional promoter and a polynucleotide encoding a protein that exhibits an amino acid sequence as set forth in SEQ ID NO;2 from amino acid position 10 through amino acid position 600 exhibiting lepidopteran insecticidal activity.
20. The expression cassette of claim 12 comprising a polynucleotide selected from the group consisting of SEQ ID Nθ:5 and SEQ ID NO:7.
21. A method of identifying in a biological sample a polynucleotide encoding a CrylA.105 protein exhibiting an amino acid sequence as set forth in SEQ ID NO:2 from about amino acid position ]0 through about amino acid position 600, said method comprising contacting said sample with a polynucleotide probe that hybridizes to the polynucleotide under stringent hybridization conditions and detecting the binding of said polynucleotide probe to said polynucleotide, wherein said binding is diagnostic for the presence of said polynucleotide in said sample.

A method of identifying in a sample a CrylA.JQS protein exhibiting an amino acid sequence as set forth in SEQ ID NO:2 from about amino acid position 10 through about amino acid position 600, said method comprising contacting said sample with an antibody that binds specifically to said protein, and detecting the binding, wherein said binding is diagnostic for the presence of said protein in said sample.
23. An isolated polynucleotide encoding an insecticidal protein exhibiting an amino acid sequence as set forth at SEQ ID NO:2 from about amino acid 1 through about amino acid 612.
24. An isolated polynucleotide encoding an insecticidal protein as set forth at SEQ ID NO:2 from about amino acid 1 through about amino acid 610.
25. The isolated polynucleotide of Claim 23 exhibiting at least about 90% identity to the nucleotide sequence as set forth at SEQ ID NO: 1.
26. The isolated polynucleotide of Claim 23 exhibiting at least about 90% identity to the nucleotide sequence as set forth at SEQ JD NO:3.
27. A hybrid insecticidal protein comprising an amino acid segment comprising from about 500 to about 600 contiguous amino acids selected from the amino acid segment as set forth at SEQ ID 3SfO:2 from about amino acid position 10 through about amino acid position 600,

A composition comprising an insectieidally effective amount of a Cry IA.105 protein exhibiting an amino acid sequence as set forth in SEQ π> NO:2 from about amino acid position 10 through about amino acid position 600, wherein said composition is selected from the group consisting of a plant cell, a bacterial cell, a fungal cell, a colloid, an emulsion, a seed coating, a bait, and a powder.
29. The composition of claim 28 wherein said Cry IA.105 protein is present in an amount from about 0.5 to about 200 parts per million (PPM).
30. The composition of claim 29 wherein said Cry IA,IO5 protein is present in an amount from about 0.5 to about 20 PPM.
31. The composition of claim 29 wherein said composition is a plant cell or a group of plant cells.
32. The composition of claim 31 wherein the polynucleotide encoding the insecticidally effective amount of said Cry IA.105 protein is present in an amount detectable using a probe that is or is complementary to a sequence selected from the group consisting of SEQ ID NO: I from nucleotide position 1401-1420 and SEQ ID NO: 1 from nucleotide position 1821-1840.
33. The composition of claim 31 wherein said insecticidally effective amount of said protein is sufficient to control a lepidopteran genus plant pest when provided in the diet of said pest, said pest being selected from the group consisting of Amicarsia, Pseudoplusia, Rachiphsla, Heliσthis, Helicoverpa, Spodoptera, Epinotia, and Armigera,
34. A method for protecting a crop in a field from lepidopteran insect infestation comprising growing a transgenic crop plant comprising an insecticidally effective amount of a Cry I A.105 protein insecticidal agent in the diet of the lepidopteran insect to inhibit the insect from surviving on said transgenic crop plant, wherein said inseciicidal agent comprises an amino acid sequence from about amino acid position 10 through about amino acid position 600 as set fonh in SEQ ID NO:2,
35. The method of claim 34, wherein said transgenic crop plant further comprises an additional insecticidal agent toxic to the same insect species as the Cryl A,] 05 and is selected from the group consisting of a Bacillus toxin, a Xenorhabdus toxin, a Photorhabdus toxin, and a dsRNA specific for suppression of one or more essential genes in said insect species.

6. The method of claim 34 or 35 wherein the yield of said crop is improved compared to the yield of an isogenic crop lacking said insecticidal agent or agents.
